Welcome to Dinner In Hand. Please read the following terms of
use and disclaimer carefully before using this web site
("Site"). This Agreement is an agreement between you and Dinner
in Hand, LLC ("Dinner in Hand") that states the terms and
conditions under which you may use the Site and receive the
Dinner in Hand service, which includes processing and delivery
of your orders. Service and the Site constitutes your agreement
to the terms and conditions set forth below. If you do not agree
with all of the terms and conditions, do not use the Site or the
Dinner in Hand Service.

Dinner in Hand Satisfaction Guarantee
All of our products and services are backed by a 100% customer
satisfaction guarantee. If you are dissatisfied for any reason,
we want to make it right. Just call us at (914)380-5084 or
contact us via e-mail customercare@dinnerinhand.com or log on
and use our Customer Inquiry e-mail -- you have up to the
expiration date printed on your dinner label. Dinner in Hand may
require the return of the product with which you are
dissatisfied before we issue a credit.
Dinner in Hand Service
Ordering through the Site.
Orders must be received before posted cutoff times for same day delivery. Available delivery windows and
delivery/membership charges will be shown as you proceed through
the ordering process. You can place your order anytime, before
your delivery date. You can modify an existing order (including
the addition or deletion of items, a change in the time or
delivery date, and the cancellation of your order) via the Web
(in the "Your Account" section of the Site) up until the posted
cutoff time on the day prior to the delivery date. To view
delivery and cutoff times visit the “how it works” section of
the site. You may cancel orders via the "Your Account" section
of the Site or by contacting our Customer Service Department at
(914)380-5084 during posted hours. Please see Help section of
the site for Customer Service hours. Cancellation of orders
after the required cutoff time cannot be accepted. We will
attempt to find a delivery option to meet your changed schedule.
Unfortunately, we cannot deliver your prepaid dinner the next
day.
Price and Availability. At Dinner in Hand we believe in
offering our customers the best product at the best price.
Although our goal is to fulfill 100% of each order, given the
perishable nature of good, from time to time products may be
unavailable due to market conditions beyond our control or to
quality that is below our standards. We reserve the right to
change select dinner ingredients contained in your order. If we
are unable to fulfill your entire order we will make every
reasonable effort to contact you prior to delivery. Once you
complete checkout, your price is guaranteed.
Delivery Service.
To receive delivery at home, you must be present to receive your
order from our driver during your selected delivery window. If
you are not at home during your selected delivery window, we
will use reasonable efforts to contact you and reschedule
delivery for that night. In such case, if we are unable to
redeliver the order to you for any reason, the order will be
canceled and you will be charged in full. In an effort to meet
the committed delivery time for all of our customers, our
delivery personnel cannot wait for you. Your order will arrive
with a packing slip that will list all of the items you have
received and were billed for. If something is missing from your
order, please call our Customer Service department at
(914)-380-5084 or log on and contact us via our Customer Inquiry
e-mail form.
Train Station Delivery.
When you registered we ask for the earliest possible train and
the latest possible train you usually take. We will be there
meeting every train till you arrive to pick up your package.
Should your plans change call us at (914)380-5084 and if someone
is home we will deliver to your home. This service is available
once a month. If you don’t meet us by 9 pm that night and no one
is home your order will be cancelled and you will be charged in
full.
In the case of inclement weather, or unforeseen delivery
complications, it may be necessary to make adjustments to our
delivery schedule, which will cause us to suspend chosen
delivery dates and times. If there will be a significant delay,
a customer service representative may call or e-mail you to let
you know the status of your delivery time. We will deliver your
order the first possible moment the conditions permit. We will
never deliver an order without a customer's consent. If your
designated delivery location (i.e., street, avenue, etc.) or day
is inaccessible, rendering us unable to make the delivery, we
will contact you to determine the best alternate location and/or
date.
Dinner In Hand agents are allowed to accept tips. Customers
are under no obligation to tip Drivers but have the option of
doing so if exceptional service is provided by the Driver.
Registration and Membership
When you first register choosing a membership you can change
your mind once you complete your free trial period. We would
like to know your preference at this point so we can prepare.
Membership charges will not occur until after your free trail is
over and you place your first membership order. So go ahead and
enjoy a fresh home cooked meal tomorrow night!
Dinner In Hand Membership Changes
Vacation breaks
Please take your vacations and put your Dinner In Hand
membership on temporary hold. If you are going away for a week
or more please e-mail us at
Customercare@dinnerinhand.com or while you are on the site
click on the Contact link within Help and we will extend your
membership by the week (s) you will be away.
Upgrading or changing membership
You can upgrade or change your membership within the first 15
days by simply paying the difference or in the case of home
delivery to train delivery – you will then have a credit with
DIH toward your next order.
After 15 days
you can change your membership by adding onto your existing
membership.
For instance: Your circumstances change and you want to switch
to home delivery and you are 1 ½ months into your 3 month
train delivery membership – we will be happy to accommodate.
Here is how it works:
Signed up for a new 3 month home delivery membership and convert
your existing membership to home delivery. The new membership is
appended to the current one. You now have a 4 ½ months left to
your membership.
If you need to switch to Train delivery from Home
Delivery after 1 ½ months of a 3 month membership we are also
happy to accommodate. Here is how this works:
You signed up for a 3 month train delivery membership and we
convert your existing train delivery membership to home
delivery. The new one is appended to the current membership.
You are charged for the renewal now; you have a credit
toward your next order. You now have a 4 1/2 month train
delivery membership to Dinner In Hand.
Registration Extras
Anyone with Food Allergies in your household, let us know what
they are.
We want to know for planning purposes. If enough people have
diet requirements, we can and will alter our menu to suit your
group.
Cellphone / Mobile numbers / Handheld devices
Plans change - that is why it is important that we have your cell
number (s). Also if you carry a handheld with internet/e-mail
capability please tell us. We will keep this information
private it will be used solely to contact you if we have a
delivery issue to resolve or some part of your order is not
available.
Access to the Dinner in Hand Service
You acknowledge that from time to time the Dinner in Hand
Service or this Site may be inaccessible or inoperable for any
reason, including, without limitation: (i) equipment
malfunctions; (ii) periodic maintenance procedures or repairs
which Dinner in Hand may undertake from time to time; or (iii)
causes beyond the control of Dinner in Hand or which are not
reasonably foreseeable by Dinner in Hand.
ID Number and Passwords. Access to the Dinner in Hand
Service is accomplished through the use of a user name (e-mail
address) and a password that will be issued to you upon
registration. You are solely responsible for any authorized or
unauthorized access to your account by any person. You agree to
bear all responsibility for the confidentiality of your password
and all use or charges incurred from use of the Dinner in Hand
Service with your password. You agree to notify Dinner in Hand
promptly of any unauthorized use of your password and you will
remain liable for any use of the Dinner in Hand Service until
you notify Dinner in Hand of the unauthorized use of your
password.
Your Account. You are responsible for, and agree to pay
promptly, all charges to your account, including applicable
taxes and purchases by you or anyone you allow to use your
account and password to access the Dinner in Hand Service. You
agree and accept responsibility for keeping all your account
information current, including address, payment information,
telephone number, e-mail address, and alternate numbers for your
order. You can update your information in the Your Account area
on our Web site or contact our Customer Service department. You
agree that you will not provide fraudulent information and that
you are solely responsible for any information you provide to
Dinner in Hand, and accept responsibility for all activities
that occur under your account or password and for restricting
access to your computer. You will comply with all laws
applicable to your activities on the Site and with this
Agreement. Dinner in Hand's secure server encrypts your payment
information so that it cannot be read as the information travels
over the Internet. Once we receive your payment information, it
is stored in our secure data center. Dinner in Hand will
exercise commercially reasonable efforts to ensure that your
payment information remains confidential. When our
registration/order form asks users to enter sensitive
information (such as credit card number), that information is
encrypted and is protected with encryption software. Our Site
encrypts your credit card prior to transmission over the
Internet using secure socket layer (SSL) encryption technology.
This technology works best when the Site is viewed using
Microsoft's Internet Explorer.
Corrections. If you need to update information previously
provided to us, please update your account information by going
to my account on the Dinner in Hand Site.
Privacy Policy. Please review our Privacy Policy, which
also governs your visit to the Dinner in Hand Site and use of
the Dinner in Hand Service, to understand our practices.
Amendment. Dinner in Hand may amend this Agreement at any
time by posting the amended terms on our Site. All amended terms
shall automatically be effective seven days after they are
initially posted on our Site. By using this Site after the
effective date of any such amendment, you agree to be bound by
any such revisions and should therefore periodically visit this
page to determine the then current Agreement to which you are
